Rule 94
Treatment costs

(1) During the service period, the civil servant will receive medical expenses equal to twelve months if he is a gazetted category employee, eighteen months if he is a gazetted first category employee and the same rankless employee, and twenty one months if he is a gazetted first category employee and twenty one month equivalent.
(2) If a civil servant or a member of his family falls ill, the Government of Nepal shall pay the following medical expenses not exceeding the amount to be received as per sub-rule (1):-
(a) Fees incurred during the examination by an approved physician for the treatment of the disease and the cost of purchasing medicine according to the prescription written after the examination,
(b) Expenses incurred during admission and treatment in the health institution according to the bill,
(c) Expenses recommended by the head of the department in the case of civil servants other than the head of the department and the secretary of the relevant ministry in the case of the head of the department for treatment in hospitals and places where there is no approved doctor. It also refers to a doctor, Kaviraj, health assistant or physician.
(d) Expenditure according to the bill incurred for all types of chirfar (surgical operation) except plastic surgery,
(e) Seventy-five percent of the daily allowance received by the civil servant in accordance with the prevailing law for the entire amount of the transportation expenses of the patient when he leaves his home or camp and goes to another district or abroad for medical treatment and when he reaches and returns to such a place, and up to one person in case of need, and food expenses.
(3) If a civil servant wants to take the medical expenses received as per this rule as advance payment, the advance payment can be made by submitting the account after being subject to this rule. If the amount taken in such advance is more than the amount to be received for the treatment, the excess amount will be deducted from the salary of the concerned civil servant in installments. Without payment of the amount to be deducted, the concerned civil servant or himselfIn case of death of a family member, the remaining amount to be deducted will be 100%.
(4) Departmental action may be taken against a civil servant who claims or receives treatment expenses in accordance with this rule by submitting false claims, including an approved physician (if an employee) who proves such false claim.
(5) If a temporary employee is ill, when the medical treatment is granted, the period of twenty years shall be considered as the full period of service and the treatment expenses shall be paid in accordance with this rule in proportion to the service period of the temporary employee who is ill. However, when a temporary civil servant is separated from the service, he will not be entitled to medical expenses according to this rule.
(6) Except in the case of disqualification for government service in the future, when a civil servant leaves the service for any other reason, he/she shall be entitled to receive a lump-sum payment of the remaining medical expenses with or without taking some of the medical expenses received during the service period in accordance with this rule. However, civil servants who have separated from the service to receive pension will be entitled to take a lump sum amount from the remaining amount to cover medical expenses. (7) When giving medical expenses to a civil servant who has not completed ten years of service, the amount specified in this rule will be given only the amount that will be paid by Damasahi. (8) In the case of a civil servant who claims medical expenses in accordance with this rule and is unable to attend the office, he shall claim sick leave as long as the sick leave is outstanding. Only if sick leave is not outstanding, other leave can be requested.
(9) According to this rule, except for those who are admitted to a health institution or have to go abroad for treatment, a civil servant can be given medical expenses up to an amount equal to one and a half months' salary earned by him in one year.
(10) According to this rule, the records of the treatment expenses received by the civil servants shall be kept by the office of expense writing and such details shall be sent to the relevant departments and civil libraries for record keeping.will fall.
(11) If the disease of a civil servant working in a remote district without means cannot be treated by a local health institution and there is a risk to his life, with the approval of the secretary of the concerned ministry, for the treatment of such civil servant from that place, the nearest place within Nepal ……….. The Nepal government will bear the cost of transporting to and from a convenient health facility.
